Nesbit Agreement Source of submission: Lancaster Co., SC Deed book G p. 137-138 Know all men by these presents that we Agnes Nesbit, William Nesbit, John Nesbit, Alexander Nesbit, James Nesbit, Benjamin Nesbit, and Joseph Nesbit all in the state of South Carolina Lancaster County and holden and firmly bound unto each other in the sum of five hundred pounds starting to be paid to each other in their heirs, exc's adm's and assigns this which payment will and hereby to be made we do hereby bind ourselves our heirs extr's Adm's and ___ of them firmly by these presents sealed with the seal and dated this 20th day of July anno domini 1791. The condition of this allegation is such that of the above bounded Agnes Nesbit, Wm NeNesbit, John Nesbit, Alexander Nesbit, James Nesbit, Benjamin Nesbit, and Joseph Nesbit their heirs exc'rs adm's for them and their parts and behalfs shall and do in all things will and truly stand to obey abide observe perform fulfill and keep in everything the ___ judgement final and determination of John Gray, Esq, Robt Montgomery Esq, John Kirk, John Lata, Robert Dunlap, Esq Alexander C___ and John Craig gentlemen independently chosen to do J___ as well on the part and behalf of each of the above named persons as another to order adjudge and determine according to same Intent and meaning of the last will and testament of Alexander Nesbit a just and equal quota or legacy accoring to the best of their knowledge and the above leg__ of the aforesaid will do ___ agree to authorize and empower the aforesaid gentlemen to hear all the allegations and red__ the grievences and ___ divide and order the estate both real and personal as they in their wisdom may think best according to the desire of the major part of the Legatees and each of ourselves mutually and severally do agree that the aforesaid gentlemen make out their judgements orders and directions and draw them in writing under their hands and keep the original until every of the above parties or persons comply with the judgements of the aforesaid gentlemen so drawn up and further we each of us do promise upon honor besides subjecting ourselves to the above penalty that we will recieve our share of said estate both real and personal and give no disturbance or discontent to one another either by word or by deed provided this award or judgement be made the contents thereof complyed with before the 7th day of Nov ensuing the date thereof then the above obligation to be void or else to be and remain in full from and ___.
