COMMENT: Thickety
Creek is about 10 miles east of the Turner Homeplace near the
Pacolet River. It is also the general area that several of
Martin Martin's sons lived in. I cannot explain why these folks
came to Henry Turner, except an Officer of the Court was
required to make the transaction legal. Apparently, Fielden was
used as a witness. |

WITNESSETH THAT FOR AND IN CONSIDERATION OF THE SUM OF THREE
HUNDRED AND THIRTY THREE DOLLARS TO ME SAID RICHARD IN HAND PAID BY
THE SAID JESSE AT AND BEFORE THE SEALING AND DELIVERING AND THESE
PRESENTS THE RECEIPT AND PAYMENT WHEREOF IS HEREBY ACKNOWLEDGED

Know all Men by these Presents, That I,
Robert Scruggs of the County of Spartanburg in the State aforesaid,
for and in consideration of the love and affection I have for my
daughter Sarah E. Roberts of the County of Spartanburg in the
State aforesaid, have granted, give and released, and by these
Presents do grant, give and release, unto the said Sarah E.
Roberts a certain lot or parcel of land lying and being in the
County and State aforesaid; situated on the mack branches of Island
Creek and bounded by lands belonging to Mary Williams, M. J.
Lawson, J. A. Scruggs and others and having the following metes
and bounds (viz),
Beginning at a stake and running N49W 4
to a Hickory, thence N34E 20.50 to a stake, thence N25E 5 to three
chesnuts, thence N37Y2E 18 to Red Oak, thence N31 W 38 to a
stake, thence along M. J. Lawsons line to the beginning corner.
Containing Fifty two (52) acres, more or less.
TOGETHER with all and singular the rights,
members, hereditaments and appurtenances to the said premises
belonging or in anywise incident or appertaining: TO HAVE AND TO
HOLD all and singular the premises before mentioned unto the
said Sarah E. Roberts her Heirs and Assigns forever, AND I do
hereby bind myself, my Heirs, Executors and Administrators to
warrant and forever defend all and singular the said premises
unto the said Sarah E. Roberts her Heirs and Assigns, against me

Scruggs of the County of Spartanburg in the State aforesaid,
have granted, bargained, sold and released, and by these Presents do
grant, bargain, sell and release, unto the said James A. B.
Scruggs a certain lot or parcel of land lying and being in the
County and State aforesaid; situated on the head waters of
Island Creek, And bounded by Willis Martin and P. Lawson and W.
J. C. Roberts and Miss Blackwell,

SOUTH CAROLINA}
To all whom these presents shall come, know ye that I, Thomas
Tod of Spartanburg County in the state aforesaid Farmer, have
for and in consideration of five pounds sterling money to me in
hand paid by Samuel Farrow, Esquire high sheriff of the county
aforesaid, have bargained, sold, aliened, released, conveyed, and
confirmed and by these presents do bargain, sell, alien, release,
convey, and confirm unto the said Samuel Farrow, Esquire, his
heirs, and assigns forever all that plantation, tract or parcel
of land containing three hundred acres {more or less} with every
appurtenance thereunto belonging or in anywise appertaining,
situate, lying, and being in the county and state aforesaid on
the north side of Enoree River, bounded south by said river,
east by James Benton’s land and west by James Couch’s land. It
being part of a tract of four hundred and fifty acres of land
granted to Charles Waters by his excellency William Moultrie,
Esquire, October 25, 1786, which said three hundred acres of
land and appurtenances thereunto belonging, were seized and sold
for the debt of the said Charles Waters and purchased by me at
public sale of the said Samuel Farrow, Esquire high sheriff
aforesaid, which said three hundred acres of land and
appurtenances the said Thomas Tod doth hereby for himself, his
heirs and assigns warrant and defend to the said Samuel Farrow,
his heirs and assigns from and against himself, his heirs, and
assigns and all persons acting by, from, or under him, his heirs
and assigns but against such persons only. In witness whereof
I have hereunto set my hand and seal this 15th March
Anno Domini, 1790.

Sanford Turner a negro boy Jackson in his own right forever,
with the following conditions annexed, that if

now being about 5 years old), then the above named negro boy
Jack shall revert back to said

Know all men by
these presents that I, Charles Waters, Constable of Enoree in
Ninety Six District in the state of South Carolina, am hold and
firmly by these presents bound unto William Heaton of Tyger
River in the said district and state aforesaid farmer in the penal
sum of five hundred pounds sterling money to be paid to the said
William Heaton, his certain attorney, his heirs, executors,
administrators or assigns to which payment well and truly to be
done, made, and paid. I firmly by these presents bind
myself, my heirs, executors, administrators and every of them as
witness my hand and seal this 19th day of October Anno
Domini 1784.
The condition of
the above obligation is such that if the above bounden Charles
Waters, his heirs, executors, administrators shall and so make
or cause to be made unto the above said William Heaton, his
heirs or assigns a sure and absolute indefeasible right in fee
simple to a certain tract or plantation of land containing two
hundred and twenty five acres of land situate lying and being on
the north side of Enoree River and bounded southerly by the said
river and on land laid out to James Benton and on land of said
Charles Waters and the Irish line which two hundred and
twenty-five acres of land is also bounded on land laid out to James
Couch being part of a tract of four hundred and fifty acre tract
of land lately surveyed by the above bound Charles Waters from
the location office, then the above obligation to be void and of
no effect, else to remain and be in full force and virtue in
law. As witness my hand and seal the day and year above
written and sealed and delivered in the presence of witness

the same, acknowledging the seal thereon made to be his seal and
further saith that the said Charles Waters also acknowledged

the Court of Equity, said Bill being exparte praying for sale of
lands belonging to the estate of Jesse Wheeler dec. Cause came
to be heard at the extra term of Aug 1845, when said Court did
order that the tracts of land plattes Nos. 2, 3, 4 should be
sold at public auction by the Commissioner. T. O. P.
Vernon as Commissioner, did on 6 Oct 1845, dispose of said lot
unto D. Ballenger for $300. Parcel platted as lot No. 3,
bounded by lands of Henry Smith, John Wheeler, Mason & Lot No.

Whereas William
Martin, Jerry Martin, O. Martin, et. al, on about the day of one
thousand eight hundred and did exhibit their petition in the
Court of Probate at Spartanburg Court House, setting forth that
Martin Martin departed this life on or about day of one thousand
eight hundred and seized and possessed in fee of a certain
plantation or tract of land containing Forty six and two thirds
acres, more or less, bounded by lands of James Harris, Calvin
Phillips, that portion and division of said lands, yet remained to
be made, which they prayed might be done.
And whereas,
afterwards, to wit: On the Eleventh day of November, in the year of
our Lord one thousand and eight hundred and Seventy one, Benj
Wofford Esq Probate judge of Spartanburg County, after due
examination did order and decree that the land described in the
said petition be sold by the Sheriff of Spartanburg, on the
first Monday in December, the next ensuing or on such other sale
day as would be most for the advantage of the parties in
interest, in a credit of twelve months, with interest from date,
except costs which must be paid cash on day of sale. And whereas
John Dewberry, as Sheriff of the County aforesaid, after having
duly advertised the said tract of land for sale by public
outcry, on the fourteenth day of December, in the year of our
Lord one thousand eight hundred and seventy one, did then openly
and publicly and according to the custom of Auction, sell and
dispose of the tract of land below described unto C. P. Turner,
of the County and State aforesaid for the sum of Thirty five
dollars ($35.00) dollars, he being at that price, the last and
highest bidder for the same. Now therefore know all men by these
presents, that I, Benj Wofford Esq., Probate Judge as aforesaid,
under and by virtue of the order and decree of the Probate Judge
aforesaid, and in consideration of the sum of ($35.00) Thirty five,
secured to be paid to the Probate Judge, aforesaid, have
granted, bargained, sold and released, and by these presents do
grant, bargain, sold and released unto the said C. P. Turner,
that certain piece, parcel, and plantation of land containing
one hundred and twenty acres, more or less, adjoining lands of
James Harris, Calvin Phillips, So Ca Manufacturing Company and
others, lying on the head waters of Thicketty creek, in the
county and State aforesaid. The interest herein conveyed and
released, is the interest of the aforesaid Martin Martin,
deceased, which is seven (7/18) Eighteenths of the whole tract
above mentioned and described. Together with all and singular,
the rights, members, hereditaments and appurtenances belonging, in
anywise incident or appertaining to the said promises and also
of the state, right, title, interest, dower, possession,
property, claim and demand, whatsoever, either at law or equity
of the heirs and representatives of the said Martin Martin,
deceased, and of the parties to this suit, or any other person
rightfully claiming or to claim the same or any part thereof, by,
from, or under their or either of them. To have and to hold the
said tract of land, with its appurtenances hereditaments and
privileges, unto the said C. P. Turner, his heirs and assigns,
to his, and their proper use and benefit forever. In witness
whereof, I, the said Benj Wofford, Esq., Probate Judge of the
County aforesaid, under and by virtue of the said order and decree,
have hereunto set my hand and seal, this fourteenth day of
December, in the year of our Lord one thousand eight hundred and
Seventy one, and in the Ninety Sixth year of the Sovereignty and
Independence of the United States of America.

This Indenture
made the 19th day of October in the year of our Lord
One Thousand Seven Hundred and Eighty Five between Benjamin
Wofford and Burrell Thomson of the state of South Carolina of
the county of Spartanburg of the one part and Henry Meredith of the
county and state aforesaid of the other part. Witnesseth
that for and in consideration of the sum of three hundred pounds
sterling money to them in hand paid by the said Henry Meredith
at and before the sealing and delivery of these presents,
receipt and payment is hereby acknowledged; hath granted,
bargained, and sold, aliened, conveyed unto the said Henry Meredith
to him, his heirs, executors, administrators and assigns forever
all that Mesuayer Tract of land containing five hundred acres
more or less being a part of six hundred acre tract lying and
being on both sides of the Enoree River, granted unto Thomas
Irvin by the honorable Arthur Dobbs, Governor of North Carolina
bearing date the twenty sixth day of March in the year One Thousand
Seven Hundred and Fifty-five. Enrolled in the Auditor
Generals office the 27th day of March 1755 and
recorded in the Secretary’s office by James Arhdnd and conveyed
to Bartlett Brown, Sr., deceased the eleventh day of May
1755. It being that part west of one hundred acres sold on the
north side of Enoree River to Mathew Couch out of the above six
hundred acres, lying on both sides of said river, the north side
being in Spartanburg County and the south side of said river in
Laurens County. Beginning at the above Mathew Couches, on
said six hundred acre line and running north to the red oak
corner thence 78 chains to a white oak thence south 78 chains to a
pine thence to the beginning tree of the six hundred acre tract a
cedar at the upper end of the Fort Shoal, thence up the said
Enoree to a poplar Mathew Couches corner, thence up the said
Couches line to the beginning with the appurtenances, situate
lying and being as aforesaid with their and every of their
rights, members and appurtenances whatsoever, and the reversion and
revisions, remainder and remainders of all and singular the lands
and tenements, hereditaments and premises hereby granted and
intended to be granted and of every part and parcel thereof and
rents, houses, surveys, profits to him or any of his or any part
or parcel of them residing, belonging, or appertaining and also
all and every estate, estates, rights, claims, interest, and
demand whatsoever of them the said Benjamin Wofford and Burwell
Thomson of or unto the said lands, tenements, premises hereby
granted with the appurtenances to the said Henry Meredith, his
heirs, and assign. The said Benjamin Wofford and Burwell
Thomson for themselves, their heirs, executors, and
administrators shall and will at all times warrant and defend
the said premises to the said Henry Meredith, heirs, executors, and
administrators and assigns, against all grant and every claim or
claims that shall or may arise form the said Benjamin Wofford
and Burwell Thomson or any other person, our heirs, executors,
administrators or assigns forever whereby the above mentioned
premises might or may be effected or encumbered by any grant or
bond or the above mentioned Benjamin Wofford and Burwell Thomson
their, heirs, executors, and administrators or assigns contrary to
the interest and meaning of these presents. In witness
whereof the said Benjamin Wofford and Burwell Thomson hath
hereunto set their hands and affixed their seals the day and
year first above mentioned.
