The Will of Daniel Palmer

"In the name of God Amen:

I Daniel Palmer of the District of Union and State of South Carolina, being old and infirm, but of sound and disposing mind, memory, and understanding, do think proper to dispose of my estate and Effects, in the following manner.

First. I give and bequeath unto my dearly beloved wife Elizabeth Rogers Palmer, the whole of my Estate both Real and Personal, during her natural life for her support and benefit, and at her death to be Equally divided amongst my five children, William, Henry, Jeffrey, Catherine Martin and Mary Pruett; the Shares to Catharine Martin and Mary Pruett, I give to them during their natural lives, and at their death to the lawful issue of their bodies.

Secondly. In order to carry the first clause of my will into Effect; it is my desire, that three respectable and disintered persons be appointed by the Ordinary of this District, to divide into Eual - five Eual lots or Shares the whole of my Estate both Real and Personal, and draw and Set off one share to Each of my above named children, and in Case Either of my children Should die before such division takes place, then the part allotted such deceased child Shall go to their children, the lawful issue of their bodies.

Third. Should the Commissioners to be appointed as above fail to make division and allotment as directed then it is my Will and I hereby authorize and direct my Executor, or Administrator with my Will annexed, to sell at public sale on a credit of twelve months the whole of my Real and Personal Estate, and to divide the proceeds Equally "amongst" (inserted) my five children above named and subject to the limitations as Stated in the first clause of this will.

Fourthly and lastly - I do hereby nominate Constitute and appoint my friend J. J. Pratt Executor to this my last will and testament, with full power to manage and Settle my Estate after the death of my wife, in a fair and Equitable manner for the benefit of my heirs, and I hereby revoke all former wills by me at any time made, and declare this to be my only true last will and testament.

In witness whereof I have herunto set my hand and seal this fifth day of May in the year of our Lord one thousand Eight hundred and thirty six,

I J. J. Pratt do certify that this will was deposited amony my private papers at the time it was Executed and that it remained these (under covered by me although I frequently made serch for it believing as I did that I had it) untill long after the death of both Daniel Palmer & his wife, that I took charge of and managed his Estate, and had before the discovery of this will made distribution of the balance of his Estate both real & personal according to the act of distributions, and it is belived according to the provisions of this will, and have at this present date settled and paid off all of them except a part of Palmers' children who do not reside in the state.

I had the will proven, and make this Statement for the regard I have to the memory of the deceased, and the desire that his wishes might be known.
