did exhibit their bill of complaint in the Court of Equity,
said Bill being exparte praying for sale of lands belonging to the
estate of Jesse Wheeler dec. Cause came to be heard at the
extra term of Aug 1845, when said Court did order that the
tracts of land plattes Nos. 2, 3, 4 should be sold at public
auction by the Commissioner. T. O. P. Vernon as
Commissioner, did on 6 Oct 1845, dispose of said lot unto D.
Ballenger for $300. Parcel platted as lot No. 3, bounded by
lands of Henry Smith, John Wheeler, Mason & Lot No.

all men by these presents that Robert McIntosh for and in
consideration of The Sum of Three Hundred Dollars to him in hand
paid by William Wheeler of the County of Yancy and State of
North Carolina the receipt whereof is hereby acknowledged have
Bargained Sold and Conveyed and by these presents does Bargain
Sell and Convey unto the Said William Wheeler and his heirs
all his right title claim interesst and demand
whatsoever Excepting one half of the minerals here by Exprefsly
reserved unto the Said grantor and his heirs; in and to the
following part or parcel of land lying and being in The County
on the waters of Higgins Branch on the North Side of the Caney
River Mountain bounded as follows: Beginning on a beach tree,
Massey Higgins S.E. Conner & runs with her line N. 26
degreess West Nineteen Poles to a Black gum & hickory near Said
line on the east bank of the branch; Thence North 28 degrees E
up the ridge to a white oak on the top of the Burnt Knob
ridge; thence with the main hight of Said ridge to the top of
Caney River Mountain; thence a western course along the main
lot of Said Caney River Mountain to a Stake at the
instersection of Cliff Knob Ridge with Said Caney River Mountain,
thence down the clif knob Ridge to or opposite Massey Higgins
corner Thense with her line to the Beginning all the cove on
Blunt Speculation land included in the above limits not
heretofore Sold: and no more be the Same more or less Supposed
to contain one hundred acres more or less. To have and to hold
the aforesaid tract or parcel of land Except The reservations herein
before made up one half of the minerals unto the Said William
Wheeler and his heirs to his and their only use and behoof for
even And the Said Robert McIntosh hereby binds himself and his
heirs Executors and Administrators and all persons wharsoever
to William Wheeler and his heirs for ever for Testamony where
of the Sai d Robert McIntosh has hereunto Set his hand and
Seal this 28 day of October A.D. 1874
